Puppystream is a product of Simplestream Inc. and is based in New York, NY.
By using the Puppystream.me website you are agreeing to be bound by the following terms and conditions. These “Terms of Use” constitute a binding legal agreement between you and Simplestream.

The following terms are referenced in this document, here’s what they mean...

• Content: Text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials.
• Site: Puppystream.me
• posting: Displaying or publishing of Content.

Terms

1. You agree to only post photos of dogs that you own or are custodian of. Puppystream is a sharing network for dog photos. Off topic photos will be deleted.
2. You may only post photos that you own or have been granted rights to publish.
3. You may not post Content that portrays harm to any creature, nude or partially nude people, sexually suggestive, gore-related or discriminatory photos.
4. You are responsible for any activity that occurs under your username.
5. You acknowledge that your publicly posted Content is accessible by anyone in the world and that this is the nature of a public content-sharing network such as Puppystream.
6. You are responsible for keeping your password secure.
7. You must not abuse, harass, threaten, impersonate or intimidate other Puppystream users.
8. You may not Hotlink Puppystream photos. Each image has it’s own url, please use that and just link back to Puppystream instead.
9. You may not use Puppystream for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
10. You may not post photos that advertise any commercial endeavor (e.g., offering for sale products or services) or otherwise engages in any commercial activity (e.g., conducting raffles or contests, displaying sponsorship banners, and/or soliciting goods or services).
11. You are solely responsible for your conduct and any Content that you submit, post, and display on Puppystream.
12. You must not crawl, scrape, or otherwise cache any content from Puppystream including but not limited to user profiles and photos.
13. You must not create or submit unwanted email or comments to any Puppystream members ("Spam").
14. You must not, in the use of Puppystream, violate any laws in your jurisdiction (including but not limited to copyright laws). Violation of any of these agreements will result in the termination of your Puppystream account. While Puppystream prohibits such conduct and content on its site, you understand and agree that Puppystream cannot be responsible for the Content posted on it and you nonetheless may be exposed to such materials and that you use the Puppystream service at your own risk.

Conditions

1. We reserve the right to modify or terminate the Puppystream service for any reason, without notice at any time.
2. We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you via email. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgement.
3. We reserve the right to refuse service to anyone for any reason at any time.
4. We reserve the right to force forfeiture of any username that becomes inactive, violates trademark, or may mislead other users.
5. We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
6. We reserve the right to reclaim usernames on behalf of businesses or individuals that hold legal claim or trademark on those usernames.

Rights Regarding Content on Puppystream

Puppystream does not claim any ownership rights to the Content that you post on Puppystream. By posting Content on Puppystream, you hereby grant to Puppystream a non-exclusive, fully paid and royalty-free, worldwide, license to use, modify, delete from, add to, publicly perform, publicly display, reproduce and translate such Content, including without limitation distributing part or all of the Site in any media formats through any media channels, except Content not shared publicly ("private") within Puppystream.

Some of the Puppystream services are supported by advertising revenue and may display advertisements and promotions, and you hereby agree that Puppystream may place such advertising and promotions on Puppystream or on, about, or in conjunction with your Content.

The manner, mode and extent of such advertising and promotions are subject to change without specific notice to you. You represent and warrant that: (i) you own the Content posted by you on Puppystream or otherwise have the right to grant the license set forth in this section, (ii) the posting and use of your Content on or through Puppystream does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights or any other rights of any person, and (iii) the posting of your Content on the Site does not result in a breach of contract between you and a third party. You agree to pay for all royalties, fees, and any other monies owing any person by reason of Content you post on or through Puppystream.

Although Puppystream's services are normally available, there will be occasions when the Site will be interrupted for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and equipment that are beyond the control of Puppystream. Also, although Puppystream will normally only delete Content that violates this Agreement, Puppystream reserves the right to delete any Content for any reason, without prior notice. Consequently, Puppystream encourages you to maintain your own backup of your Content. In other words, Puppystream is not a backup service. Puppystream will not be liable to you for any modification, suspension, or discontinuation of the Puppystream Services, or the loss of any Content and business concerns you may have related to said Content.

Privacy

All information provided by the user is strictly confidential, with the exception of any user posted information in the publicly available areas of the Site. Puppystream reserves the right to distribute aggregated demographic information provided by the user, but Puppystream will never release any personal information about the user without permission. However, Puppystream reserves the right to release user information if user has violated the Puppystream Terms of Service, if the information is subpoenaed, or if the user has committed unlawful acts.

Legal Policy

"Puppystream" is a registered trademark of Simplestream. Any unauthorized use of this name is a violation of state, federal and international trademark laws. All Puppystream art and text on this website are copyrighted. All user-posted Content is copyrighted © to their respective owners. Puppystream directs full legal responsibility of Content to their respective users.

Puppystream is not responsible for the content of any user-posted Content, nor is it in affiliation with any entities that may be represented in the Content.

Limitation of Liability

User's use of Puppystream is entirely at his or hers own risk. If you are dissatisfied with any aspect of Puppystream's service or with these Terms of Use, or any other rules or policies, your sole remedy is to discontinue the use of Puppystream. Puppystream's services are provided on an "as is" basis without warranties of any kind, either expressed or implied, constructive, or statutory, including, without limitation, any implied warranties of merchantability, non-infringement or fitness for a particular purpose.

Puppystream makes no guarantee of availability of service and reserves the right to change, withdraw, suspend, or discontinue any functionality or feature of Puppystream's services. In no event shall Puppystream be liable for any damages whatsoever. This includes direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use Puppystream’s services or any content thereon.
